"Kreativität im digitalen Zeitalter" - ist das Motto der 3. Oekonux-Konferenz in Wien vom 20.-23.05.2004. Das Programm erscheint durchwachsen, gleichwohl in mancher Hinsicht vielversprechend.

Bei Sascha Kremer (Vertretbar Weblawg) wird derzeit eine akademisch erscheinende Diskussion um die Rechtsnatur von GPL-Lizenzen geführt.

Im Kern geht es jedoch um ein sehr praktisches Problem: Kann durch einfache Bezugnahme auf ein Linzenzmodell eine - kostenlose - Lizenz erteilt werden, ohne dass der Lizenzgeber für den Bestand des eingeräumten Rechts haftet? Diese Kernfrage war bereits Hauptkritikpunkt von Karl Friedrich Lenz im Rahmen seiner Kritik an "Creative Commons" (G) - here at Lenz Blog (E).

Ich werfe diese Frage hier nochmals auf.

In my opinion the problem is not the legal classification of the license but the limitation of liability for granting a gratuitous license under German Law.
