Der später Verurteilte wird aufgrund einer Zeugenaussage gefasst. Zur ordentlichen Verurteilung bedurfte es allerdings in der Regel zweier Zeugen oder eines Geständnisses - zur Wahrheitsfindung und um der Gerechtigkeit Willen war nach damaligem Verständnis die Folter angezeigt.
Summary: There has been a rough discussion about torture in Germany. The background was a kidnapping of the eleven year old boy Jakob Metzler in Frankfurt. The police tried to find the victim by threat with torture to the alleged criminal Magnus Gäfgen (Gaefgen). The question was, if special circumstances, f.e. such as to prevent terror acts as of Septemer 11th or similar crimes, may excuse this handling, and if law should rule this case.
